1. Legal Notice — Service Provider Identification

2. Subject and Acceptance

These Terms of Use govern access to and use of the Guardian Web service provided through guardianweb.es and its subdomains. By accessing or using the Service, you fully and unconditionally accept these Terms. If you disagree, do not use the Service.

3. Service Description

Guardian Web is a web security SaaS platform that enables users to protect PHP/WordPress websites via a shield file (gw-shield.php), monitor traffic and security incidents in real time, manage blocked IPs, GeoIP rules, security notifications, and access statistics and maintenance tools from a centralised panel.

Guardian Web is a security support tool, not an infallible or comprehensive security system. Its use does not guarantee absolute protection against all possible attacks or vulnerabilities (see Section 8).

4. Registration and Account

Registration requires a valid email address and password. You must be at least 14 years old. Each person or entity may register only one account. You are responsible for the confidentiality of your credentials and must notify Guardian Web immediately of any unauthorised access to your account. You commit to providing accurate and current information.

Payments are managed through LemonSqueezy. Guardian Web does not store or process credit card data. Subscriptions auto-renew monthly until cancelled. No refunds are issued for already-billed periods, except as required by law or where the issue is solely attributable to Guardian Web (requests within 7 days to hello@guardianweb.es). Prices are subject to applicable VAT.

6. Acceptable Use

You agree to use the Service only for lawful purposes and to install the shield only on websites you own or are authorised to manage. Prohibited activities include: illegal or fraudulent use; reverse engineering of the software; reselling access without written permission; conducting attacks against third parties; introducing malware; creating false accounts or misrepresenting your identity.

Violation may result in immediate account suspension or termination without refund and may lead to legal action.

7. Intellectual Property

All intellectual property rights in the Guardian Web service — including software, source code, design, logos, trademarks, documentation and content — belong to the service provider or its licensors. You are granted a personal, non-exclusive, non-transferable licence to use the Service under these Terms. This licence does not include the right to copy, distribute, modify, create derivative works, reverse-engineer or commercially exploit the Service or any of its components.

8. Limitation of Liability

Important clause: Guardian Web is a security tool designed to reduce risks, not eliminate them entirely. No security system offers absolute protection.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Guardian Web does not warrant that the Service will be uninterrupted, error-free, or completely secure, or that the shield will detect or prevent all attacks.

To the fullest extent permitted by law, Guardian Web shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, loss of profits or business interruption, or for damages from security breaches or cyberattacks even if Guardian Web was installed. Guardian Web's total maximum liability for any claim shall not exceed the total amount paid by the user in the 3 months preceding the event, or €30 for free-plan users.

This limitation does not apply where prohibited by law (e.g., death or personal injury caused by negligence) or to mandatory consumer rights.

9. Service Availability

Guardian Web makes reasonable efforts to keep the panel available but provides no specific SLA guarantee. The gw-shield.php file operates autonomously on the customer's server using a local cache, continuing to protect sites even if the panel is temporarily unavailable. Planned maintenance will be communicated in advance where possible.

10. Data Processing

User data is governed by the Guardian Web Privacy Policy, which forms an integral part of these Terms. Regarding visitor data processed by the shield, the user acts as data controller and Guardian Web as data processor (GDPR Art. 28). Users must inform their own visitors about the use of Guardian Web in their privacy policy.

11. Modifications

Guardian Web may modify these Terms at any time. Material changes will be notified by email with at least 15 days' advance notice. Continued use after the new Terms take effect constitutes acceptance.

12. Cancellation and Termination

Users may cancel their account at any time from the control panel. Guardian Web may suspend or terminate accounts for breach of these Terms, fraudulent use, non-payment, or upon law enforcement request — with or without prior notice depending on severity. Termination for material breach carries no refund obligation.

13. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Disputes shall be submitted to the courts of the provider's city of residence, except for consumer users, who retain the benefit of mandatory consumer protection rules in their country of residence. EU consumers may also use the ODR platform: https://ec.europa.eu/consumers/odr.
